诉讼制度改革背景下主办侦查员的责任制——以命案侦查为视角

【摘要】：在以审判为中心的诉讼制度改革背景下,运用实证研究的方法,对近年来命案卷宗评比活动中检察院不起诉处理与法院作无罪判决的命案材料进行剖析,分类总结归纳命案侦查相关问题,提出加强主办侦查员队伍建设,革新侦查理念,夯实侦查基础,深度应用前沿刑事技术,建立健全以审判为中心的监督体系和案件质量考评体系,构建以审判为中心司法改革相适应的侦查职能实现路径模型。
[Abstract]:Under the background of the lawsuit system reform with trial as the center, using the method of empirical research, this paper analyzes the homicide materials that the procuratorate does not handle and the court makes the acquittal in recent years. Classification summary of homicide investigation related issues, proposed to strengthen the construction of the team of organized investigators, innovation of the concept of investigation, consolidate the basis of investigation, in-depth application of frontier criminal technology. Establishing and perfecting the supervision system and case quality evaluation system, and constructing the model of the realization path of the investigation function which is adapted to the judicial reform with the trial as the center.
