限制自由强制措施中的电子监控

【摘要】：限制自由强制措施中的电子监控是指对于没有进行关押而只是限制自由的犯罪嫌疑人和被告人可以使用电子手(脚)镯和手机定位的方式进行电子监控,在国外的保释措施中普遍采用这一做法,我国的监视居住措施中也采用这一方法进行监控,这是非常必要的。在电子监控实施中,应当遵守法定程序、注重对隐私权的保护,还要与其他监管措施配合使用。在以后的立法中,我们还应当在取保候审中应用电子监控措施。
[Abstract]:The electronic surveillance in the coercive measures of restriction of liberty means that the suspects and defendants who have not been detained but only restricted their freedom can use the electronic hand (foot) bracelet and mobile phone to locate the electronic surveillance. It is very necessary to use this method in the bail measures of foreign countries, and in our country's residential surveillance measures, which is very necessary. In the implementation of electronic monitoring, we should abide by the legal procedures. Pay attention to the protection of privacy, but also with the use of other regulatory measures. In future legislation, we should also be on bail pending trial in the application of electronic monitoring measures.
