论疑难刑事案件侦办之能动性

【摘要】：疑难刑事案件穷尽了现有调查手段也无法查明案情,不得不中断侦查、起诉和审判,暂时终结诉讼,如何实现社会正义?法律制度缺陷、侦办失误等能动性偏差,都会形成疑难刑事案件。犯罪现场发现太迟、错过取证时机、超过诉讼时限等,都体现了客观条件限制之难。取证时机综合反映出案件侦查的主客观条件。侦破活动需要发现疑点,分析和克服疑难;终结侦查需要排除合理怀疑,组织证据体系;依法判决也需自由心证,它们都依赖于司法能动性。罪案证明的概率,需要能动地调节证明标准。各类疑难刑事案件无罪判决的势头方兴未艾,正在倒逼我国案侦机制的调整与完善。
[Abstract]:Difficult criminal cases have exhausted the existing means of investigation and can not find out the circumstances of the case, have to interrupt the investigation, prosecution and trial, the temporary end of the proceedings, how to achieve social justice? Defects in the legal system, errors in investigating and handling, and other dynamic deviations will all result in difficult criminal cases. The crime scene is too late to be discovered, missed the opportunity to collect evidence, and exceeds the time limit of the proceedings, etc. It reflects the subjective and objective conditions of the case investigation. The detection activities need to find the suspicious points, analyze and overcome the difficulties, end the investigation need to remove reasonable doubt, organize the system of evidence. They all rely on judicial initiative. The probability of proof of a crime needs to be dynamically adjusted to prove the standard of proof. The momentum of acquittal in various difficult criminal cases is in the ascendant. It is forcing the adjustment and perfection of the investigation mechanism of our country.
