论外国惩罚性损害赔偿判决的部分承认与执行

【摘要】：各国承认与执行外国惩罚性损害赔偿判决的态度不同,主要因为他们对惩罚性损害赔偿金额的具体数额存在较大争议。有的国家对惩罚性损害赔偿判决全部承认与执行,也有国家全部拒绝承认与执行,还有国家部分承认与执行。随着惩罚性损害赔偿制度的自我完善,比例原则和分割方法的运用对赔偿标准产生了新的影响,为部分承认与执行此类判决提供了方法论基础。建议我国法院在今后的司法实践中采用分割方法承认与执行判决中与实际损失相符部分,对超出实际损失部分可以按比例承认与执行。
[Abstract]:The attitude of countries to recognize and enforce foreign punitive damages is different, mainly because of their dispute over the specific amount of punitive damages. Some countries recognize and enforce all punitive damages judgments. With the self-improvement of the punitive damages system, the application of the principle of proportionality and division has had a new impact on the standard of compensation. It provides a methodological basis for the partial recognition and enforcement of such judgments. It is suggested that the Chinese courts adopt the split method to recognize and enforce the judgment in accordance with the actual loss in the future judicial practice. The portion exceeding the actual loss may be recognized and enforced proportionately.
