论庭审中的诱导性询问

【摘要】：随着我国刑事庭审制度的改革,对抗性因素在庭审中的表现也越来越显著,交叉询问制度已经成为庭审中直接调查广义证人(证人、被害人)的主要方式。而我国刑事诉讼法的司法解释却禁止在所有法庭询问(包括交叉询问)中使用与此配套的询问技术——诱导性询问,这一规则并无合理性解释,在比较法上更是一项反规则。这是一个涉及如何发现真相、如何保护被告人权利、如何合理促成法官心证的重要证据学问题。通过考察那些允许诱导性询问的证据制度,比较不同国家司法实践的适用规则,进而分析诱导性询问在我国能够适用的心理基础和伦理基础,从而明晰对诱导性询问的理解,并结合我国目前司法实践表现出的“诱导怪像”和司法改革的大潮进一步分析诱导性询问存在的可行性和必要性。
[Abstract]:With the reform of criminal trial system in our country, adversarial factors are becoming more and more obvious in the trial, and cross-examination system has become the direct investigation of broad witnesses (witnesses, witnesses, witnesses). The judicial interpretation of our criminal procedure law prohibits the use of the accompanying interrogation technique-inductive questioning in all court inquiries, including cross-questioning. This rule has no reasonable interpretation. This is an important evidentiary question about how to discover the truth, how to protect the rights of the defendant, how to reasonably promote the judge's evidence. By comparing the applicable rules of judicial practice in different countries, this paper analyzes the psychological and ethical basis on which induced inquiry can be applied in China, so as to clarify the understanding of inductive inquiry. Combined with the current judicial practice of our country and the tide of judicial reform, the feasibility and necessity of the existence of inductive inquiry are further analyzed.
