【摘要】：正修改后的《人民检察院刑事诉讼规则(试行)》(以下简称《规则》)明确规定死刑执行临场监督由人民检察院监所检察部门负责。笔者结合参与监督法院执行死刑过程的实践,对死刑执行临场监督制度诸多需要完善之处进行探讨。一、完善我国死刑执行临场监督制度的必要性死刑是我国最严厉的刑罚,检察机关通过科学完善的死刑执行临场监督制度,确保死刑执行在法
[Abstract]:The revised Criminal procedure rules of the people's Procuratorate (hereinafter referred to as "the rules") clearly stipulate that the supervision of the execution of the death penalty on the spot shall be the responsibility of the procuratorial department of the prison of the people's procuratorate. The necessity of perfecting the supervision system of execution on the spot of death penalty in our country is the most severe punishment in our country.
