三个方面正确理解临时保护性约束措施

【摘要】：正根据修改后刑诉法第二百八十五条第三款的规定:"对实施暴力行为的精神病人,在人民法院决定强制医疗措施前,公安机关可以采取临时的保护性约束措施。"但是,修改后刑诉法的规定较为简略,司法解释也未见详细规范,理论上也少有研究,导致临时保护性约束措施的内容不甚明了,对此,笔者认为,结合修改后刑诉法的规定,应从三个方面正确理解临时保护性约束措施。一是对临时保护性约束措施的适用对象应作狭义解释。在我
