数字环境中的电子证据规则——基于LEDE项目的比较研究

【摘要】：数字化的普及催生了新的证据——数字证据(在我国称为电子证据)。由于数字/电子证据对信息技术的强依赖特性,在证据的收集、鉴定、认证等规则上有着不同于传统证据的诸多特点,给各国司法实践中传统证据法和证据规则的运用带来了极大挑战。针对这一话题,北美的《数字环境中的证据法》项目在2015年发布了一份阶段性报告。本文介绍了该项目的研究成果,结合我国的现状探讨其研究结论在我国的适用性,并在基础上对比我国与北美环境下数字/电子证据状况的异同,引出下一阶段的研究问题。
[Abstract]:The popularity of digitization has given birth to new evidence-digital evidence (known as electronic evidence in our country). Due to the strong dependence of digital / electronic evidence on information technology, the collection and identification of evidence, Authentication and other rules have many characteristics different from the traditional evidence, which brings great challenges to the application of the traditional evidence law and the evidence rules in the judicial practice of various countries. The "evidence in the Digital Environment" project in North America published a periodic report in 2015. This paper introduces the research results of the project, and discusses the applicability of the research conclusions in our country according to the present situation of our country. On the basis of the comparison of the digital / electronic evidence between China and North America, the next stage of research is brought forward.
