论生态文明建设的司法保障机制

【摘要】：生态文明是人类反思过去发展模式所提出的一种新型发展模式,在现实环境的压力与党和政府的共同推动下,其已被提升至与经济建设同等重要的高度。司法环节作为生态文明建设制度保障的关键一环,必须顺应生态文明建设社会化、专业化等特性,在原有制度的基础上加以创新。完善环境公益诉讼制度,设立专业化的环保法庭,采取环境保护联动机制等新型司法保障机制回应了生态文明建设的现实需求。但在司法保障机制革新的过程中应注意与立法、行政的配合,并应在既定法律框架内寻求突破。
[Abstract]:Ecological civilization is a new kind of development model put forward by human beings reflecting on the past development model. Under the pressure of the real environment and the joint promotion of the Party and the government, ecological civilization is a new type of development model put forward by human beings. It has been promoted to a level of equal importance to economic construction. As a key link in the system of ecological civilization construction, the judicial link must conform to the characteristics of socialization and specialization of ecological civilization construction. Innovate on the basis of the original system, perfect the environmental public interest litigation system, set up specialized environmental protection courts, The new judicial safeguard mechanism such as the environmental protection linkage mechanism has responded to the realistic demand of the construction of ecological civilization, but in the course of the reform of the judicial safeguard mechanism, attention should be paid to the cooperation with the legislation and the administration, and a breakthrough should be sought within the established legal framework.
