侦查阶段检警职权配置的改革研究

【摘要】：检警关系是指警察机关和检察机关在审前程序中行使各自职权的相互关系。检警关系的职权配置是否合理,直接影响到整个刑事诉讼程序的公正和效率。党的十八届四中全会以来,推进以审判为中心的诉讼制度改革的目标被确立,并且在2016年10月10日最高院、最高检、公安部、国家安全部、司法部联合印发《关于推进以审判为中心的刑事诉讼制度改革的意见》,1这对我国构建合理的检警职权配置奠定了良好的基础。因此,本文以笔者实际工作中的案件为蓝本,分析我国检警职权配置在实践中出现的种种问题,立足我国的国情,坚持"以审判为中心"的改革精神,构建新型检警关系,进一步优化诉讼结构和诉讼程序,对我国的检、警在侦查阶段的职权配置进行思考和改革,论证了检察指导侦查的可行性,并对检察指导侦查模式存在问题提出几点改革优化方案,努力适应当前我国"以审判为中心"诉讼制度改革的需求。
[Abstract]:The relationship between procuratorial and police organs refers to the mutual relationship between police organs and procuratorial organs exercising their respective functions and powers in pretrial proceedings, and whether the allocation of functions and powers of procuratorial police relations is reasonable, Since the fourth Plenary session of the 18 Central Committee of the CPC Central Committee, the goal of promoting the reform of the trial centered litigation system has been established, and in October 10th 2016, the Supreme Court, Supreme Procuratorate, and Ministry of Public Security, The Ministry of National Security and the Ministry of Justice jointly issued opinions on promoting the reform of the criminal procedure system centered on trial. This laid a good foundation for the establishment of a reasonable allocation of powers and powers for prosecutors and police in China. Taking the cases in the author's actual work as the blueprint, this paper analyzes the problems in the practice of the allocation of procuratorial and police powers in our country, bases itself on the national conditions of our country, adheres to the spirit of "taking trial as the center", and constructs a new type of procuratorial and police relationship. Further optimizing the litigation structure and procedure, thinking and reforming the distribution of powers and powers of our country's procuratorate and police in the investigation stage, demonstrating the feasibility of procuratorial guidance for investigation, This paper also puts forward some reform and optimization schemes for the problems in the prosecutorial guidance investigation mode in order to meet the needs of the current reform of the litigation system of "trial as the center" in our country.
