【摘要】：正检察案例指导制度,是指最高人民检察院通过选编检察机关办理的在认定事实、证据采信、适用法律和规范裁量权等方面具有普遍指导意义的案例,为全国检察机关处理同类案件提供指导和参考,规范检察官执法办案行为,促进公正行使自由裁量权,促进法律统一正确实施的一项检察制度。检察案例指导制度是在深刻把握我国检察工作规律和总结检察管理经验基础上,坚持中国特色社会主义法律体系前提下,以正确理解和适用法
