我国转型期下公证制度转型之困——以房产产权法定公证为契

【摘要】：由于我国产权登记制度的缺陷,使得房产产权变动极其容易引发纠纷,学者们为此呼吁将房产产权公证法定化,以期解决这一困境,但我国立法却迟迟未对此做出回应。笔者通过思考房产产权法定公证制度理想落空背后的原因,认为关键在于我国目前的公证行业无力承担制度的赋予,这种无力的困境又恰恰因制度的不赋予所引发,并认为,公证制度的转型不仅仅依赖于制度的支撑,更有赖于公证行业整体素质的提升。
[Abstract]:Because of the defect of the property right registration system in our country, the change of the property right is very easy to cause the dispute, so the scholars call for the legalization of the property right in order to solve this dilemma. The author thinks that the key lies in the fact that the notarization industry in our country is unable to bear the burden of the legal notarization system of real estate property right by pondering the reasons behind the collapse of the ideal of the legal notarization system of real estate property rights. This kind of powerless predicament is caused by the lack of institution, and believes that the transformation of notarization depends not only on the support of the system, but also on the improvement of the overall quality of the notarization industry.
