刑事诉讼地方性试点改革对刑事诉讼立法的影响分析

【摘要】：刑事诉讼地方性试点改革正在影响刑事诉讼立法。从积极层面分析,这种影响可以诱发刑事诉讼立法方式与技术的改变,从而提高立法的实效性。从消极层面来看,这种影响也可能导致刑事诉讼立法确立一些合理性并不充分的制度规则,并消解立法应有的审慎。为了消除刑事诉讼地方性试点改革对刑事诉讼立法的负面效应,未来应该增强试点改革操作的规范性,提高立法者甄别试点方案的能力,强化民主立法相关制度建设。
[Abstract]:The local trial reform of criminal procedure is affecting the legislation of criminal procedure. From the positive level, this influence can induce the change of the legislative method and technology of criminal procedure, thus improve the effectiveness of the legislation. This influence may also lead to the establishment of some system rules which are not reasonable enough in the criminal procedure legislation, and the elimination of the due prudence in the legislation, in order to eliminate the negative effects of the local trial reform of the criminal procedure on the criminal procedure legislation. In the future, we should strengthen the standardization of pilot reform operation, improve the ability of legislators to discriminate the pilot scheme, and strengthen the construction of democratic legislation related system.
