论捕后必要性审查制度的不足与完善

【摘要】：新修订的刑事诉讼法第93条确立了捕后羁押必要性审查制度,这充分体现了人权保障原则、羁押比例性原则和检察监督原则,具有坚实的法理基础。但修订后的刑事诉讼法实行一年来,该制度在司法实践中使用的比较少,检察机关面临着依职权启动难、法律规定过于概括难于操作、检察建议效力不足及羁押替代性措施不完善等问题。针对这些问题,建议通过增设部分强制性启动的条款、细化法律条文、提高检察建议的说理性、完善听证会制度和羁押替代性措施来完善这一制度,使其在司法实践中更好的运行,以保障公民的合法权益。
[Abstract]:Article 93 of the revised Criminal procedure Law establishes the system of examining the necessity of detention after arrest, which fully embodies the principle of human rights protection, the principle of proportionality of custody and the principle of procuratorial supervision. It has a solid legal foundation. However, since the revised Criminal procedure Law was put into practice for one year, the system has been used less in judicial practice, and the procuratorial organs are faced with the difficulty of starting according to their functions, and the legal provisions are too general and difficult to operate. The effectiveness of procuratorial recommendations and detention of alternative measures are not perfect and so on. In view of these problems, it is suggested that this system should be perfected by adding part of the mandatory starting clause, refining the legal provisions, improving the rationality of the procuratorial proposal, perfecting the hearing system and the alternative measures of custody. Make it run better in judicial practice, in order to protect the legitimate rights and interests of citizens.
