【摘要】：民事诉讼中成本与效益的考虑,制约着当事人实施或放弃诉讼手段,也制约其具体诉讼行为的选择。诉讼保险分担了当事人的诉讼费用和律师费用等风险,必然会影响当事人作出案件起诉或撤诉的决定,也会不同程度地影响何时与何种情况起诉或撤诉,以及当事人和保险人控制费用成本的动机和行为。了解诉讼保险对当事人诉讼行为的影响,才能更好地发挥诉讼保险的积极作用,促进诉讼程序的有序运行,充分保护当事人的合法权益。
[Abstract]:The consideration of cost and benefit in civil action restricts the litigant to carry out or abandon the means of litigation, but also restricts the choice of his specific action. The litigation insurance shares the risks of litigant's litigation cost and lawyer's expense, etc. It will inevitably affect the decision of the parties to prosecute or withdraw the case, and will also affect, to varying degrees, when and what circumstances to prosecute or withdraw the case, As well as the motive and behavior of the parties and the insurer to control the cost of the expenses. Only by understanding the influence of the litigation insurance on the litigant's litigation behavior, can the positive role of the litigation insurance be better brought into play, and the orderly operation of the litigation procedure can be promoted. Fully protect the legitimate rights and interests of the parties concerned.
