【摘要】：基层人民法院在社会管理创新中的作用研究，是一个全新的课题，就基层人民法院在社会管理创新中如何更好发挥作用，本文结合法院工作实际从理论和现实两个方面进行了分析探索。党的十六届四中全会，针对我国转型期社会结构发生变化，社会状态更加开放，阶层群体更加活跃、诉求不断提升的现实，提出“加强社会建设和管理，推进社会管理体制创新”。随后，党中央对社会管理创新的内容、目的及创新的方法步骤等进一步阐述，明确了各种内涵。党的十八大直接把建设一个稳定有序、公平正义、平安幸福的和谐社会，明确为今后加强和创新社会管理的目标方向。作为社会管理主体的人民法院，尤其是承担着大部分法院工作任务的基层人民法院，在社会管理创新中如何进行角色定位，应当发挥什么样的作用，也就成了学界研究的对象。但是，，受多种因素的影响，这些研究还不足以解决法院面临的各种实际问题。通过对淄博市张店区人民法院实地调查，从法院职能、作用层面，在解析人民法院参与社会管理创新的涵义及意义基础上，对基层人民法院在社会社会管理创新中面来的问题，作用定位进行了分析，并就基层人民法院在社会管理创新中的作用发挥进行了有益的探索。从结构来看课题主要分为三个部分。首先第一部分，交代了课题的来源与课题研究的意义、课题的国内外研究现状、课题的研究方法和创新点等。以此作为课题研究的出发点，并在此基础上对课题内容展开自己的研究。第二部分，就法院在社会社会管理创新中的定位，和必要性进行了分析，对各种学说进行了类分，指出了基层人民法院社会管理创新的必要性，指出了基层人民法院在社会管理创新中的主要作用。第三部分是课题的核心部分，针对目前基层人民法院在社会管理创新中面临问题存在的原因，从司法体制问题、司法理念落后、司法队伍构成不合理和司法内外部环境不和谐方面进行了深度解析，指出问题存在的原因，进一步就基层人民法院如何更好发挥社会管理创新作用提出了自己的对策。从树立先进的司法理念，改革现行审判运行与矛盾化解机制，完善法官队伍管理提升法官素质和优化司法外部环境、形成社会管理创新合力等方面，对基层人民法院参与社会管理创新提出了建议和思考。并把让人民群众在每一个案件中都感受到公平和正义，作为基层人民法院在社会管理创新中作用发挥的落脚点。
[Abstract]:The study of the role of grass-roots people's courts in the innovation of social management is a new topic. On how the grass-roots people's courts can play a better role in social management innovation, This article combines the court work reality from the theory and the reality two aspects carries on the analysis exploration. The fourth Plenary session of the 16th CPC Central Committee, in view of the fact that the social structure has changed, the social state has become more open, the stratum groups have become more active, and the demands have been constantly upgraded, it is proposed to "strengthen social construction and management." Then, the CPC Central Committee further elaborated on the contents, purposes and methods and steps of social management innovation, and clarified various connotations. The 18th National Congress of the Party directly built a stable, orderly, fair and just party. A peaceful and happy harmonious society is clearly the target direction for strengthening and innovating social management in the future. As the main body of social management, the people's courts, especially the people's courts at the grass-roots level, which undertake most of the work of the courts, How to position the role in the social management innovation and what role it should play has become the object of academic research. However, it is influenced by many factors. These studies are not enough to solve all kinds of practical problems faced by the court. Through the field investigation of the people's court in Zhangdian District of Zibo City, on the basis of analyzing the meaning and significance of the people's court's participation in the innovation of social management, from the level of the functions and functions of the court, This paper analyzes the problems and role orientation of the basic people's courts in the social management innovation, and makes a beneficial exploration on the role of the basic people's courts in the social management innovation. In terms of structure, the subject is mainly divided into three parts. The first part explains the source of the subject and the significance of the research, the status quo of the research at home and abroad. The research methods and innovation points of the subject are taken as the starting point of the research, and on the basis of the research, the author carries out his own research on the content of the subject. The second part analyzes the position and necessity of the court in the innovation of social and social management. This paper classifies various theories, points out the necessity of social management innovation of grass-roots people's courts, and points out the main role of grass-roots people's courts in social management innovation. The third part is the core part of the subject. In view of the problems existing in the social management innovation of grass-roots people's courts at present, this paper makes a deep analysis of the problems in the judicial system, the backward concept of the judiciary, the irrational composition of the judicial team and the disharmony of the internal and external environment of the judiciary. This paper points out the causes of the problems, and further puts forward some countermeasures on how the grass-roots people's courts can better play the innovative role of social management. Improve the quality of judges, improve the quality of judges, optimize the external environment of the judiciary, form the social management innovation and join forces, etc. This paper puts forward some suggestions and thoughts on the participation of grass-roots people's courts in the innovation of social management, and regards it as the foothold of the basic people's courts in the social management innovation to let the people feel fair and just in every case.
