【摘要】：在判断和认定案件中的专门性问题上,英美法系国家采用了专家证人制度,而我国则是采用了鉴定人鉴定制度。本文深入分析研究了专家证人制度的主体要素及规则要素,在此基础上进一步分析了专家证人制度存在的优势和不足以及英美法系国家的自我完善措施。通过对专家证人制度的探讨,分析目前我国司法鉴定制度在吸收借鉴专家证人制度过程中所取得的重大进步及仍存在的不足,理性的分析我国的鉴定人制度与专家证人制度诉讼基础的不同及我国鉴定人制度的优势,并提出完善我国司法鉴定制度的具体措施,如,明确诉前鉴定的启动权、完善专家辅助人的质证程序、确立鉴定意见的可采信标准以及通过司法解释完善鉴定意见的范围等,使我国司法鉴定制度趋于科学化、规范化,增强司法权威、保障当事人的诉讼权利。
[Abstract]:The expert witness system is adopted in the common law system, while the expert witness system is adopted in our country. In this paper, the main elements and rules of the expert witness system are deeply analyzed and studied. On this basis, it further analyzes the advantages and disadvantages of the expert witness system and the self-improvement measures of the common law countries. This paper analyzes the great progress made in the process of absorbing and drawing lessons from the system of expert witnesses in the current judicial expertise system of our country and the shortcomings that still exist. This paper analyzes rationally the differences between the system of expert witnesses and the system of expert witnesses and the advantages of the system of expert witnesses in our country, and puts forward some concrete measures to perfect the system of judicial identification in our country, such as defining the right of initiation of the appraisal before litigation. Perfect the procedure of cross-examination of expert assistant, establish the acceptable standard of appraisal opinion and perfect the scope of appraisal opinion through judicial interpretation, make the judicial appraisal system of our country more scientific, standardized, and strengthen the judicial authority, etc. To protect the litigant's right of action.
