共有财产涉讼类型化析解

【摘要】:我国民事诉讼法将共同诉讼分为必要共同诉讼与普通共同诉讼。在众多属于必要共同诉讼的案件中,共有财产涉讼最为典型。按照我国法律对必要共同诉讼的规定,共同诉讼人必须一同起诉或应诉,法院必须合并审理且作出合一判决。准此,如果不论何种情形,共有财产涉讼均为必要共同诉讼的话,共同诉讼人必须共同起诉或应诉方才当事人适格,恐生起诉不能等问题。有鉴于此,宜按照民法规定,共有财产涉讼时区分共有权与持份权,前者需全体共有人同时起诉或应诉,而后者则许可共有人单独起诉或应诉。
[Abstract]:The civil procedure law of our country divides the joint action into necessary joint action and common joint action. Among the many cases that belong to the necessary joint action, joint property litigation is the most typical. The co-litigants must sue or appear together, and the court must combine the proceedings and give a judgment in one. If in any case, the joint property litigation is a necessary joint action, A joint litigant must jointly sue or respond to a lawsuit before the parties are qualified, and the fear of suing cannot wait. In view of this, it is advisable to distinguish the joint right and the holding right when joint property is involved in litigation in accordance with the provisions of the Civil Law, The former requires all co-owners to sue or respond simultaneously, while the latter allows the co-owners to sue or respond separately.
