从传统文化中吸取检察制度的营养

【摘要】：正长期以来,受传统落后执法理念的影响,司法实践中,往往偏颇理解传统文化"中庸"、"和谐"的本意,检察机关至今仍存在一些不善监督、不愿监督、不敢监督的问题。对此,笔者以为,不妨从我国传统文化的角度对现有诉讼监督的理念、功能、制度和程序设计等方面进行审视,挖掘提炼传统文化中的精髓加以继承发扬。谨提两个方面:一要培育法律文化,吸取精华,正本清源。将传统文化培育作为法律文化建设的必要组成部分,使传统文化精髓理念在诉讼工作理念中固化下来,改变传统观念。
[Abstract]:For a long time, under the influence of the traditional backward idea of law enforcement, in judicial practice, the intention of the "mean" and "harmony" of traditional culture is often biased. The procuratorial organs still have some poor supervision and do not want to supervise. The author thinks that from the perspective of our traditional culture, we can examine the concept, function, system and program design of the current litigation supervision. Dig and refine the essence of traditional culture and carry it forward. First, we should cultivate the legal culture, absorb the essence, and clear the root of the source. Take the cultivation of the traditional culture as an essential part of the construction of the legal culture. Make the essence of traditional culture in litigation work concept solidified down, change the traditional concept.
