行政调解制度的法理分析

【摘要】:当前,我国处于经济高速发展、社会转型的关键时期,利益主体多元化,各种矛盾激化,合理高效地解决这些纠纷,维护社会秩序的稳定,构建具有中国特色的社会主义和谐社会成为全国人民的共同目标。行政调解制度在当前的经济和社会生活中,越来越成为行政主体解决矛盾纠纷的重要手段之一。从理论方面而言,现代行政法平衡理论、行政合法性和正当性理论、契约化理论都为行政调解作作为解决矛盾纠纷的重要手段提供了强大的理论依据。从实践方面来看,作为一种准司法性质的制度,行政调解能够提高行政效能,体现善治思想,节约司法资源,维护当事人权益,提高公民权利意识,维护公民尊严,更将有助于构建和完善我国多元化的纠纷解决制度。 目前我国行政调解制度存在行政调解协议性质定位模糊,欠缺法律效力、行政调解主体地位不平等,相对人缺乏救济途径以及行政调解组织结构不合理,调解人员素质参差不齐等问题,导致这些问题的原因主要是我们在借鉴国外优秀经验方面存在误区,另外法律制度的缺失也是一个重要原因。因此,我们可以从行政调解协议性质、人员素质以及组织结构等方面来建立和完善我国的行政调解制。我们深信,随着行政调解理论研究的不断深入,我国行政调解将会焕发出新的生机,将在解决社会纠纷、促进社会和谐方面发挥更大的作用。
[Abstract]:At present, our country is in a critical period of rapid economic development and social transformation. The main bodies of interest are diversified, various contradictions are intensified, these disputes are resolved reasonably and efficiently, and the stability of social order is maintained. Building a harmonious socialist society with Chinese characteristics has become the common goal of the whole country. It has become one of the important means for administrative subjects to resolve contradictions and disputes. Theoretically speaking, modern administrative law balance theory, administrative legitimacy and legitimacy theory, The contract theory provides a strong theoretical basis for administrative mediation as an important means of resolving contradictions and disputes. In practice, as a quasi-judicial system, administrative mediation can improve administrative efficiency and reflect the idea of good governance. Saving judicial resources, safeguarding the rights and interests of the parties, raising the awareness of citizens' rights and safeguarding the dignity of citizens will help to construct and perfect our country's diversified dispute resolution system. At present, the administrative mediation system in our country has vague orientation of the nature of the administrative mediation agreement, lack of legal effect, unequal status of the administrative mediation subject, lack of remedies by the relative party and unreasonable organizational structure of the administrative mediation. The quality of mediators is uneven. The main reason for these problems is that we have some misunderstandings in drawing on the excellent experience of foreign countries, and the lack of legal system is also an important reason. We can establish and perfect the administrative mediation system in our country from the aspects of the nature of the administrative mediation agreement, the quality of the personnel and the organizational structure. We are convinced that with the deepening of the research on the theory of administrative mediation, Administrative mediation in China will bring new vitality and play a greater role in resolving social disputes and promoting social harmony.
