刑事诉讼法关于技术侦查措施规定中的模糊性语言及其限定研究

【摘要】：作为此次刑事诉讼法修改的一大亮点,我国2012年刑事诉讼法首次规定了技术侦查措施。但是新法中有关技术侦查措施的规定包含了大量的模糊性语言。根据我国现阶段的实际状况,这些模糊性语言有其存在的必然性和现实基础。然而过多的模糊性语言使法律的可操作性、稳定性和统一性大打折扣,也为侦查机关滥用权力打开方便之门。基于国内外司法实践,结合模糊语言学的相关理论,我国有必要从立法、法律解释和程序设计三重维度,对这些模糊性语言进行限定。
[Abstract]:As a highlight of the revision of the Criminal procedure Law, China's Criminal procedure Law in 2012 for the first time stipulated technical investigation measures.However, the provisions of the new law on technical investigation measures contain a large number of vague language.According to the present situation of our country, these fuzzy languages have their inevitability and realistic basis.However, too much fuzziness makes the operation, stability and unity of the law less, and it also opens the door for the investigating organs to abuse their power.Based on the judicial practice at home and abroad and the relevant theories of fuzzy linguistics, it is necessary to limit these fuzzy languages from the three dimensions of legislation, legal interpretation and programming.
