论家事诉讼中家事“三员”协作体系的构建

【摘要】：家事审判员、家事调解员与家事调查员,简称为家事"三员",是法院处理家事纠纷必不可少的专业团队。自本轮家事审判改革以来,各地试点法院对于家事"三员"均做了不同程度的实践探索,但依然存在角色定位模糊不清、职能范畴界定不明、协作机制尚未健全的问题,为此,可在借鉴域外司法经验的基础上,通过探索家事"三员"的角色分离,准确定位各自的职能范畴,寻求彼此之间的协作互动来重构我国家事诉讼中"三员"的协作体系。
[Abstract]:Family judges, family mediators and family investigators, referred to as "three members", are the necessary professional team for the court to deal with family disputes.Since this round of family trial reform, the trial courts in various localities have done some practical exploration to the "three members" of family affairs to varying degrees, but there are still problems such as ambiguous role orientation, unclear definition of functional categories, and unsound coordination mechanism.On the basis of drawing lessons from the foreign judicial experience, we can reconstruct the cooperation system of "three members" in family litigation in our country by exploring the separation of the roles of "three members" of family affairs, accurately locating their respective functional categories, and seeking the cooperative interaction between them.
