拉美国家的司法改革与政治转型研究

【摘要】：司法机构是西方民主政治中三大权力中心之一,虽然其政治功能在历史上因为不独立而受到限制,但在推进司法改革和不断巩固民主化的过程中,公民和集体的各种宪法权利得以在司法机构获得主张,而正是在宪法的司法化过程中司法机构的政治作用不断增强。政治司法化改变了拉美国家的政治格局,司法机构也成为各种政治势力争夺的新舞台。拉美国家的司法改革正是政治转型的重要组成部分,从司法改革的角度可以观察拉美政治结构和政治角色的最新变化以及政治转型的基本方向。
[Abstract]:The judiciary is one of the three major power centers in western democratic politics. Although its political function has been restricted by its lack of independence in history, it has been in the process of promoting judicial reform and consolidating democratization.All kinds of constitutional rights of citizens and collectives can be advocated in the judicial organs, and the political role of the judicial organs is increasing in the process of the constitution judicature.Political judicature has changed the political pattern of Latin American countries, and the judiciary has become a new stage for all kinds of political forces.The judicial reform in Latin American countries is an important part of the political transformation. From the angle of judicial reform, we can observe the latest changes in the political structure and role in Latin America and the basic direction of the political transformation.
