论我国法律援助制度的完善——建立公设辩护人系统

【摘要】：我国2012年《刑事诉讼法》修改扩大了刑事法律援助的适用范围,并且完善了法律援助制度的实施模式,但是司法实践中刑事辩护率过低的问题仍然没有得到解决。依据美国的实践经验,以"援助律师"为主要模式的法律援助体系存在着很多制度上的缺陷,例如,缺乏统一的管理机制、辩护效率低辩护效果不能保证等,这也成为其阻碍刑事辩护率得到提高的最主要原因之一。而公设辩护人系统的建立则能够有效的解决这一问题。因此,在我国未来的司法改革中,可以考虑建立公设辩护人系统,在完善法律援助体系的同时,提高刑事辩护率。
[Abstract]:The revision of our country's Criminal procedure Law in 2012 has expanded the scope of application of criminal legal aid and improved the mode of implementation of the legal aid system, but the problem of too low criminal defense rate in judicial practice has still not been solved.According to the practical experience of the United States, there are many defects in the legal aid system with the aid of lawyers as the main model. For example, the lack of a unified management mechanism, the low efficiency of defense can not guarantee the effectiveness of defense, and so on.This is also one of the main reasons for its obstruction of the increase in the rate of criminal defense.The establishment of public defender system can effectively solve this problem.Therefore, in the future judicial reform of our country, we can consider establishing the public defender system to improve the criminal defense rate while perfecting the legal aid system.
