【摘要】：民事举证责任分配制度系民事诉讼过程中最核心的制度之一,该制度的目的解决的是案件事实真伪不明时法官应该怎样裁判的问题,纵观国内外对举证责任分配制度的各种学说的历史延续,该制度一向受到理论界及实务界的高度重视。但我国由于长期以来实行依职权主义诉讼模式,受传统的审判理念影响,举证责任分配制度曾经在理论及实务界得不到应有的重视。审判方式改革强烈要求当事人举证责任,其地位相对凸显,但由于理论准备不足以及立法不够完善,审判实践中许多案件举证责任怎样在当事人间分配的问题仍然得不到有效解决。本文在对举证责任分配相关理论考察分析的基础上对审判实践中的具体案例分析,探索了我国民事举证责任分配现状及存在的问题,试图对我国民事举证责任分配原则和司法实践的运用进行探讨,并总结出事实真伪不明的举证责任和裁判的规则。
[Abstract]:The distribution system of civil burden of proof is one of the most core systems in the process of civil litigation. The purpose of this system is to solve the problem of how the judge should judge when the facts of the case are unknown.Throughout the history of the theory of burden of proof distribution system at home and abroad, the system has always been highly valued by the theoretical and practical circles.However, due to the practice of ex officio litigation mode for a long time and influenced by the traditional trial idea, the distribution of the burden of proof has not received due attention in the theoretical and practical circles.The reform of trial mode strongly demands the burden of proof of the parties, and its status is relatively prominent, but due to inadequate theoretical preparation and imperfect legislation,In trial practice, the problem of how to distribute the burden of proof in many cases is still not solved effectively.Based on the investigation and analysis of the relevant theories of burden of proof distribution, this paper analyzes the specific cases in trial practice, and probes into the present situation and existing problems of the distribution of civil burden of proof in China.This paper attempts to probe into the distribution principle of civil burden of proof and the application of judicial practice, and sums up the burden of proof and the rules of adjudication.
