民事执行内部监督研究

【摘要】：在民事执行领域,"执行难"、"执行乱"已经成为影响司法程序顺利进行的最后一道屏障,俨然已成为司法顽疾,而对执行权的监督不到位是造成执行乱的主要原因之一,要解决执行权运行过程中存在的种种弊端,必须建立一套完整的执行监督理论以及运行机制,用权力来有效监督制约权力,为解决"执行乱"提供高质有效的门径。关于执行监督权的研究,无论是法学界关于此问题的研究,还是我国民事诉讼程序的实施现状,关注的焦点都集中在民事执行的外部监督尤其是对民事执行工作的检察监督,而对民事执行内部监督的研究却乏人问津,然而内部监督的有效运转却对执行工作的顺利进行有着不可替代的效应,它不仅可以有效规范执行权的行使,也可以最大程度上实现司法程序的公平,提高司法效率,本文是以执行权的权力属性为理论基础,针对执行权所具有的行政权和司法权的双重属性,对执行裁决权与执行实施权进行比较分析,寻求执行权内部监督存在的问题,从而提出相关建议。
[Abstract]:In the field of civil enforcement, "enforcement difficulty" and "enforcement disorder" have become the last barrier that affects the smooth progress of judicial process, and has become a stubborn judicial disease, and the lack of supervision over the enforcement power is one of the main reasons for the disorder. In order to solve the problems existing in the operation of executive power, it is necessary to establish a set of complete executive supervision theory and operation mechanism, to effectively supervise and restrict the power with power, and to provide a high quality and effective way to solve the "execution disorder". On the research of executive supervision power, whether the research on this issue in the legal circles or the implementation status of civil procedure in our country, the focus of attention is on the external supervision of civil execution, especially on the procuratorial supervision of civil execution. However, the effective operation of the internal supervision has an irreplaceable effect on the smooth implementation of the work, it can not only effectively regulate the exercise of executive power. It can also maximize the fairness of the judicial process and improve judicial efficiency. This paper is based on the power attribute of executive power, aiming at the dual attributes of executive power and judicial power. In this paper, the author makes a comparative analysis of the power of execution and the power of execution, and tries to find out the problems existing in the internal supervision of the power of execution, and then puts forward some relevant suggestions.
