未成年人附条件不起诉考察制度研究

【摘要】：随着新《刑事诉讼法》的颁布实施，未成年人附条件不起诉制度得以正式确立，，这一制度具有重大意义，而考察机制是其关键要素，其价值和作用更不容小觑。本文对我国司法实践中关于此机制的探索进行了介绍和分析，并对德国、日本和美国的相关制度进行了考察，在此基础上，阐述了我国附条件不起诉考察机制方面所存在的问题，并从考察主体、附加义务、考察期限、评估机制、考察结果等方面提出了进一步完善未成年人附条件不起诉考察机制的建议。
[Abstract]:With the promulgation and implementation of the new Code of Criminal procedure, the system of conditional non-prosecution of minors has been formally established. This system is of great significance, and the inspection mechanism is the key element, and its value and function should not be underestimated. This paper introduces and analyzes the exploration of this mechanism in the judicial practice of our country, and investigates the relevant systems of Germany, Japan and the United States, on the basis of which, This paper expounds the problems existing in the investigation mechanism of conditional non-prosecution in our country, and from the aspects of the subject of investigation, the additional obligation, the inspection period, the evaluation mechanism, Some suggestions are put forward to further improve the mechanism of non-prosecution of minors.
