听讼者的素养与气度

【摘要】：正法官耐心倾听而不是参加争辩,是作出正确判断的重要前提。始终保持沉着镇静、彬彬有礼,无论行动还是安坐,都能给人以内敛克制的感觉才好,这是听讼者应有的素养和气度近来我国司法公信力受到不少质疑,法官与各方的关系也出现一些不太正常的情形。比如,在刑事诉讼中,对抗的本应是控辩两方,现如今却是法官和律师的冲突愈演愈烈;在民事诉讼中,真正对抗的是原告和被告,法官只需耐心听取双方陈述和辩论,等双方辩出个输赢,论出个高低,掌握个"火候",适时而坚定
