超越现实主义刑事司法:从理性选择到德性认同

【摘要】：法律现实主义不仅对刑事司法的制度构建产生了重要影响,而且对刑事裁判的产生过程也具有实质性意义。现实主义刑事司法以理性选择作为人性基础,近年来受到德性主义之诘问。刑事司法的过程是一种理性选择但不能仅仅是一种理性选择,其必须经过实践理性的洗礼并逐步形塑德性的共识,最终形成基于法律职业共同体的公平、正义等内在德性认同的理想刑事司法模式。
[Abstract]:Legal realism not only has an important influence on the construction of criminal justice system, but also has substantial significance to the process of criminal adjudication. Realistic criminal justice is based on rational choice and has been questioned by virtue in recent years. The process of criminal justice is a rational choice, but not just a rational choice. It must be baptized by practical reason and gradually shape the consensus of morality, and finally form the fairness based on the legal professional community. The ideal criminal justice model of justice and other internal virtue identity.
