民事检察制度的体系化革新

【摘要】：新民事诉讼法对民事检察制度进行了一系列重大修订,这对检察工作既是机遇亦是挑战。检察机关应当理性把握民事检察监督原则的作用界域,积极探索利用民事公诉权维护公益的科学路径,充分发挥检察建议的独特功能,严格遵守检察权介入民事执行领域的前置条件,正确运用调查核实权等检察权行使的保障性机制。
[Abstract]:The new civil procedure law has made a series of major amendments to the civil procuratorial system, which is both an opportunity and a challenge to the procuratorial work. The procuratorial organs should rationally grasp the scope of the functions of the principles of civil procuratorial supervision, actively explore the scientific path of using the civil right of public prosecution to safeguard the public good, and give full play to the unique function of the procuratorial proposals. Strictly abide by the prerequisite conditions for procuratorial power to intervene in the field of civil execution, and correctly use the safeguard mechanism for the exercise of procuratorial power, such as the right to investigate and verify.
