提升对虚假诉讼的监督合力

【摘要】：正2017年1月14日,最高人民检察院检察长曹建明在全国检察长会议上强调,各级检察机关要大力推进民事检察监督,积极探索行政检察监督,常态化开展虚假诉讼监督工作。在此背景下,检察机关应当顺势而为,不断加强刑民衔接、程序衔接和工作机制衔接,形成密切协作的虚假诉讼监督格局。一、加强刑民衔接,构建民事制裁与刑事制裁协同治理模式。虽然民事诉讼法规定了对虚假诉讼行为的制裁措施,但并不妨碍
[Abstract]:In January 14, 2017, Cao Jianming, the procurator general of the Supreme People's Procuratorate, stressed at the national procuratorate conference that the procuratorial organs at all levels should vigorously promote civil procuratorial supervision, actively explore administrative procuratorial supervision, and normalize the supervision of false litigation. In this context, the procuratorial organs should follow the situation and continuously strengthen the cohesion of the criminal and the people and the procedural title. Connect with the working mechanism to form a close cooperative pattern of false litigation supervision. First, strengthen the connection between the criminal and the people, and construct the cooperative governance model of civil sanction and criminal sanctions. Although the civil procedure law stipulates the sanctions on the false action, it does not prevent it from hindering.
