“民告官”受案范围扩大趋势探析

【摘要】：受案范围作为行政诉讼的重要组成部分,力求衡平司法理论和司法实践之间的矛盾,不断接近理想模式。修改后的《行政诉讼法》受案范围依旧采取"概括+列举"方式,其原因在于:受案范围的修改受认识局限的制约,基于国情实际和行政诉讼发展的需求。修改后的《行政诉讼法》对"民告官"受案范围的突破体现在:增加了受案范围列举事项,受案范围扩展到部分抽象行政行为。探寻将内部行政行为纳入诉讼程序,以发布司法解释和指导性案例方式对受案范围的界定加以有效补正,可以实现"民告官"受案范围多层级细化的功效,能将"民告官"真正付诸于司法实践。
[Abstract]:As an important part of administrative litigation, the scope of accepting cases tries to balance the contradiction between judicial theory and judicial practice and approaches the ideal mode. The scope of the revised Administrative procedure Law still adopts the method of "general enumeration". The reason is that the revision of the scope of the case is restricted by the limitation of cognition, and is based on the reality of national conditions and the needs of the development of administrative litigation. The breakthrough of the revised Administrative Litigation Law to the scope of accepting cases is reflected in the increase of the list of items in the scope of accepting cases, and the extension of the scope of cases to some abstract administrative acts. To explore how to bring the internal administrative action into the litigation procedure, and to issue judicial interpretation and guide cases to effectively correct the definition of the scope of the case, we can realize the effect of multi-level refinement of the scope of the case against the official. Can "people sue the official" really put into judicial practice.
