我国建立自由贸易试验区临时仲裁制度的意义及路径

【摘要】：我国根据有关国际条约承认国外临时仲裁裁决的效力,但国内立法中临时仲裁制度缺位,这不利于在国际交往中贯彻对等、互惠原则,不利于保护我国商事主体在国际商贸活动中的应有权益。自由贸易试验区是我国建设"一带一路"的基础平台和重要节点,其发展需要稳定、可预期、法治化的临时仲裁机制,使企业之间的民商事纠纷以及投资者与东道国之间的投资争端得到高效、及时的解决。《横琴自由贸易试验区临时仲裁规则》构建的以临时仲裁为主、仲裁机构和司法机构介入为辅的仲裁体系,对其他自由贸易试验区具有普遍借鉴意义。
[Abstract]:Our country according to the relevant international treaties that the effectiveness of foreign temporary arbitration, but temporary arbitration domestic legislation in the absence of system, which is not conducive to international exchanges in implementing equivalence, principle of reciprocity, is not conducive to the protection of the rights and interests of the commercial subject should be in China in the international trade activities. Free trade test area is our country building along road base The development of the basic platform and important nodes needs a stable, predictable, legal and temporary arbitration mechanism, which makes the civil and commercial disputes between enterprises and the investment disputes between the investors and the host country efficiently and promptly. The interim arbitration rules of the Hengqin free trade test zone are based on temporary arbitration, arbitration institutions and judicature. The arbitration system supplemented by institutional intervention is of universal reference to other free trade pilot areas.
