论诱惑侦查的适用与法制规范

【摘要】：诱惑侦查的本质决定其不适合明示写入刑诉法,人们大多将其视为一种侦查方法或谋略,与秘密侦查措施关系密切,但也由此产生了诸多争议。作为打击隐蔽型或无被害人犯罪的有效方法,各国从不同视角对其严加规制,强调诱惑侦查只是为了发现犯罪而不是制造犯罪。2015年公布的深化公安改革和深化检察改革的意见为今后完善和发展诱惑侦查指明了方向,也为诱惑侦查启动之审查提供了契机。笔者认为,应以立案前后为界分,设计不同情形下诱惑侦查的适用范围、条件和启动模式,这对解决学界之争议或有裨益。
[Abstract]:The essence of enticement investigation determines that it is not suitable to be explicitly written into the Criminal procedure Law. Most people regard it as a kind of investigative method or strategy, which is closely related to secret investigative measures, but it has also generated many disputes. As an effective way to crack down on hidden or victimless crime, countries strictly regulate it from different perspectives. It is emphasized that the purpose of seduction investigation is to find out the crime but not to make the crime. The opinions on deepening the reform of public security and deepening the procuratorial reform published in 2015 have pointed out the direction for perfecting and developing the temptation investigation in the future, and also provided an opportunity for the examination of the initiation of the temptation investigation. The author believes that the scope, conditions and starting mode of temptation investigation should be designed according to the boundaries before and after filing the case, which may be beneficial to the settlement of disputes in academic circles.
