【摘要】：关于财产保全制度,现行的《民事诉讼法》已有相关表述,但为使其更加完善,《最高人民法院关于适用中华人民共和国民事诉讼法若干问题的意见》(以下简称《民诉意见》)、《最高人民法院关于适用中华人民共和国担保法若干问题的解释》、《最高人民法院关于人民法院执行工作若干问题的规定》等司法解释都对财产保全法律概念做了近一步的补充和完善。更为重要的是,民事财产保全制度对于当事人在整个诉讼过程中合法权益的保护、解决司法实务中存在的“执行难”问题,以及维护社会公平正义等都有着至关重要的意义。然而由于法律规定的疏漏,造成我国财产保全程序在司法实务中还有许多问题难以解决,尚需更深层次的研究。特别是民事财产保全中复议制度、案外人异议制度以及财产保全国家赔偿制度的缺失或不健全,极大地影响了当事人合法权益的保障和人民法院案件的审理效率以及司法权威的提高。因此,在现行的民事财产保全制度中建立或完善相应制度,对于进一步保障当事人的合法权益、实现财产保全制度的最终目的等,都具有极大的现实意义。
[Abstract]:With regard to the property preservation system, the current Civil procedure Law has already made relevant statements. However, in order to make it more perfect, the Supreme people's Court's opinions on the Application of the Civil procedure Law of the people's Republic of China (hereinafter referred to as "opinions on the Civil procedure Law of the people's Republic of China") and the Supreme people's Court on the Application of the guarantee Law of the people's Republic of China "interpretation of dry problems", "provisions of the Supreme people's Court on several issues concerning the execution of the people's Court" and other judicial interpretations have further supplemented and perfected the legal concept of property preservation. More importantly, the civil property preservation system plays an important role in protecting the legitimate rights and interests of the parties in the whole process of litigation, solving the problem of "difficult execution" in judicial practice, and maintaining social fairness and justice. However, due to the omission of legal provisions, there are still many problems in the judicial practice of property preservation procedure in our country, which need to be further studied. In particular, the system of reconsideration in the preservation of civil property, the system of dissent from other parties to the case and the system of state compensation for property preservation are missing or imperfect, It greatly affects the protection of the parties' legitimate rights and interests, the trial efficiency of the people's court cases and the improvement of the judicial authority. Therefore, it is of great practical significance to establish or perfect the corresponding system in the current civil property preservation system for further protecting the legitimate rights and interests of the parties and realizing the ultimate purpose of the property preservation system.
