我国未成年人犯罪记录处置制度完善研究

【摘要】：新修订的《中华人民共和国刑事诉讼法》通过立法的形式确立了我国未成年人犯罪记录封存制度。该制度的运用对帮助未成年犯顺利回归社会,开始正常的学习、工作和生活,发挥了积极的作用。但是,随着法律的进一步实施,该制度的规定过于概括,诸如适用范围、适用主体以及适用程序规定不够具体等弊端逐步显现。为克服我国现行未成年人犯罪封存制度存在的弊端,在考察和借鉴国外相关制度实践的基础上,通过废除或调整与本制度相冲突的法律、法规,设置独立的未成年人犯罪记录管理系统,加强法律监督等举措来完善我国未成年人犯罪记录封存制度,并在此基础上进一步探索构建符合我国国情的未成年人犯罪记录消灭制度。本论文主要由四个篇章构成,第一个篇章主要是介绍未成年犯罪记录封存制度的理论依据及意义,第二个是探讨域外未成人年犯罪记录处置制度,第三部分是对我国犯罪记录封存制度的现状与存在的问题进行分析,论文最后一部分主要是通过提出可行性建议以完善我国未成年人犯罪记录处置制度。
[Abstract]:The newly revised Criminal procedure Law of the people's Republic of China establishes the system of keeping juvenile criminal records in the form of legislation. The application of this system has played an active role in helping juvenile criminals to return to society smoothly and start normal study, work and life. However, with the further implementation of the law, the provisions of the system are too general, such as the scope of application, the applicable subject and the applicable procedure provisions are not specific and so on. In order to overcome the drawbacks of the existing system of juvenile delinquency in our country, on the basis of investigating and drawing lessons from the practice of relevant systems in foreign countries, by repealing or adjusting the laws and regulations that conflict with this system, Setting up an independent juvenile criminal record management system, strengthening legal supervision and other measures to improve our juvenile delinquency record sealing system, On the basis of this, we further explore and construct the system of the elimination of juvenile delinquency records in accordance with the national conditions of our country. This thesis is composed of four chapters. The first chapter mainly introduces the theoretical basis and significance of the system of closing and keeping juvenile criminal records. The second chapter is to discuss the system of disposal of juvenile criminal records in foreign countries. The third part is to analyze the current situation and existing problems of our country's criminal record sealing system. The last part of the paper is to improve the juvenile criminal record disposal system by putting forward feasible suggestions.
