最高人民法院民商事指导性案例的司法应用研究

【摘要】：随着我国案例指导制度的逐步推进,司法实践援引指导性案例的现象与日俱增,尤其是民商事领域。目前,关于民商事指导性案例的司法应用已成为案例指导制度所要讨论的热点问题。本文针对最高人民法院发布的民商事指导性案例,以"北大法宝-司法案例库"中的数据作为研究对象,探讨其在发布和应用方面的现状,从不同的角度出发,归纳和总结其在司法应用中呈现出来的规律和特点,并以应用频率最高的指导案例24号为例进行了实体性分析。然后对其在司法应用中存在的问题进行阐述和分析的基础上,提出了完善我国民商事指导性案例司法应用的相关建议和保障措施。
[Abstract]:With the gradual advancement of the case guidance system in our country, the phenomenon of invoking instructive cases in judicial practice is increasing day by day, especially in the field of civil and commercial affairs. At present, the judicial application of civil and commercial guidance cases has become a hot issue to be discussed in the case guidance system. Aiming at the guiding cases of civil and commercial affairs issued by the Supreme people's Court, this paper takes the data in the "Fa Bao-Judicial case Library" of Peking University as the research object, discusses the present situation of its publication and application, and sets out from different angles. The law and characteristics of judicial application are summarized, and the case No. 24, which has the highest application frequency, is taken as an example to carry on the entity analysis. Then on the basis of expounding and analyzing the problems existing in the judicial application, the author puts forward the relevant suggestions and safeguard measures to perfect the judicial application of the guiding cases of civil and commercial affairs in our country.
