【摘要】：专利侵权纠纷仲裁，是指仲裁机构根据纠纷双方达成的仲裁协议，依法居中对纠纷做出仲裁裁决的行为。由于仲裁具有灵活性、自愿性、专业性、保密性和高效性的特点，仲裁方式解决专利侵权纠纷已在欧美等发达国家得到了广泛应用，但在我国的实践才刚刚起步且困难重重，，其中影响因素既有理论论证的不足，也有制度设计的症结，还有传统观念的束缚。本文在介绍专利侵权纠纷的特点及其主要解决方式的基础之上，对仲裁解决专利侵权纠纷进行优势分析，提出我国专利侵权纠纷仲裁解决的法理依据，剖析我国当前专利侵权纠纷仲裁的现状和问题，借鉴WIPO仲裁与调解中心以及美国、日本、法国等国家的相关制度设计和实践经验，提出完善我国专利侵权仲裁机制的工作思路、立法建议和具体措施。本文第二章首先介绍了几种常见的专利侵权纠纷解决模式，为提出专利侵权纠纷仲裁做好铺垫；其次，提出本文主题，介绍专利侵权纠纷仲裁的含义，并对其进行优势分析。第三章针对我国专利侵权纠纷仲裁制度进行考察分析，一方面通过分析我国相关立法，为我国专利侵权纠纷仲裁提供法理依据，另一方面，介绍我国专利侵权纠纷仲裁现状，并从立法、机构设置和程序衔接三个方面指出存在的问题。第四章和第五章介绍了WIPO仲裁与调解中心以及美国、日本、英国、法国、加拿大等国家有关专利侵权纠纷仲裁的相关立法和实践，并总结归纳其对我国专利侵权纠纷仲裁制度的启示。第六章为本文的重点章节，提出在立足于我国的现实和需要的基础之上，借鉴域外相关制度设计和实践，提出完善我国专利侵权纠纷仲裁制度的工作思路和具体措施。
[Abstract]:Arbitration of patent infringement dispute refers to the act of arbitration institution in accordance with the arbitration agreement reached by the two parties to the dispute and mediating the arbitration award of the dispute according to law. Due to the characteristics of flexibility, voluntariness, professionalism, confidentiality and efficiency, arbitration has been widely used in developed countries, such as Europe and America, but the practice in our country is just beginning and difficult. The influencing factors are not only the deficiency of theoretical argument, but also the crux of system design, as well as the shackles of traditional ideas. On the basis of introducing the characteristics of patent infringement disputes and their main solutions, this paper analyzes the advantages of arbitration in resolving patent infringement disputes, and puts forward the legal basis for the arbitration settlement of patent infringement disputes in China. This paper analyzes the current situation and problems of patent infringement arbitration in China, draws lessons from the WIPO Arbitration and Mediation Center and the relevant system design and practical experience of the United States, Japan, France and other countries, and puts forward the working ideas of perfecting the patent infringement arbitration mechanism in China. The second chapter introduces several common modes of patent infringement dispute resolution, which can pave the way for the arbitration of patent infringement dispute. Secondly, it puts forward the theme of this paper, and introduces the meaning of patent infringement dispute arbitration. The third chapter investigates and analyzes the arbitration system of patent infringement disputes in China. On the one hand, it provides the legal basis for the arbitration of patent infringement disputes by analyzing the relevant legislation of our country; on the other hand, it provides a legal basis for the arbitration of patent infringement disputes in China, on the other hand, This paper introduces the status quo of patent infringement arbitration in China, and points out the existing problems from three aspects: legislation, institutional setup and procedure convergence. Chapter four and chapter five introduce WIPO Arbitration and Mediation Center and the United States, Japan, Britain, France, the United States of America, Japan, the United Kingdom, France, the United States of America, Japan, Britain, France. The relevant legislation and practice of patent infringement dispute arbitration in Canada and other countries, and summarize its enlightenment to the arbitration system of patent infringement dispute in our country. Based on the reality and need of our country, this paper puts forward the working ideas and concrete measures to perfect the arbitration system of patent infringement dispute in our country based on the design and practice of foreign relevant system.
