我国检察机关量刑监督制度研究

【摘要】：检察机关作为国家法律监督机关是由宪法和法律明确规定的,检察机关依照法律的规定对法院的刑事诉讼活动进行监督,是具有中国特色的检察制度。虽然检察机关有着提起公诉与进行监督两个职能,其量刑监督权的行使与公诉权的行使也并不相冲突,不会影响法院审判的独立性。所以,这种具有中国特色的社会主义检察制度,对于维护司法公正、保障人权和促进社会和谐有着重要意义。但是在实践中我国检察机关量刑监督制度却存在着很多的问题。内部的考核制度会使得检察机关在进行量刑监督时有所顾虑,同时,法院对量刑活动的垄断也使得检察机关难以进行量刑监督。这都会减弱检察机关量刑监督的效果。究其原因,除了立法上的不完善之外,还有检察机关固有的观念问题,传统的重定罪,轻量刑观念以及司法上惯常的工具主义价值观并未从检察机关的大脑中根除。因此,完善我国检察机关量刑监督制度具有重要意义。完善我国检察机关量刑监督制度主要从以下几个方面着手:首先,确立我国检察机关量刑监督的实体标准;其次,进行量刑程序改革;完善量刑建议制度;最后,引入类案监督,丰富检察机关量刑监督的手段。期望通过这样的方式,能够完善检察机关的量刑监督,实现社会的公平正义,从而有利于构建社会主义法治社会。
[Abstract]:The procuratorial organ as the national legal supervision organ is clearly stipulated by the constitution and the law, and the procuratorial organ supervises the criminal action of the court in accordance with the law, which is a procuratorial system with Chinese characteristics. Although the procuratorial organ has two functions of public prosecution and supervision, the exercise of the power of sentencing supervision and the exercise of the right of public prosecution are not in conflict with each other, which will not affect the independence of the court. Therefore, the socialist procuratorial system with Chinese characteristics plays an important role in safeguarding judicial justice, safeguarding human rights and promoting social harmony. However, in practice, there are many problems in the system of sentencing supervision of procuratorial organs in China. The internal examination system will make the procuratorial organ have some concerns when carrying on the sentencing supervision, at the same time, the court monopoly on the sentencing activity also makes it difficult for the procuratorial organ to carry on the sentencing supervision. This will weaken the procuratorial organs sentencing supervision effect. The reason is that in addition to the imperfect legislation, there is also the inherent concept of procuratorial organs, the traditional conviction, light sentencing concept and judicial usual instrumentalism values have not been eradicated from the brain of procuratorial organs. Therefore, it is of great significance to perfect the sentencing supervision system of our country's procuratorial organs. In order to perfect the sentencing supervision system of procuratorial organs in our country, we should start from the following aspects: first, establish the substantive standard of sentencing supervision of procuratorial organs; secondly, carry out the reform of sentencing procedure; perfect the sentencing suggestion system; finally, Introduction of type of case supervision, enrich the means of sentencing supervision of procuratorial organs. It is expected that through this way, the procuratorial organs' supervision of sentencing can be perfected, and social fairness and justice can be realized, which is conducive to the construction of a socialist society ruled by law.
