【摘要】：在我国刑事诉讼中，逮捕是最严厉的强制措施，如果适用不当则会侵犯人权，故而对逮捕的研究显得尤为重要。新刑诉法细化了逮捕条件，完善了审查逮捕制度，其对审查逮捕工作有很多积极的影响，但从实施以来的实际效果看，仍有许多不尽人意的地方。鉴于逮捕条件的准确把握是科学适用逮捕强制措施的关键点，本文以新刑诉法第79条为视角，在解读新刑诉法关于审查逮捕工作的相关规定后，结合司法实务操作中的困惑，分析原因所在，并提出对策建议，以期完善我国审查逮捕制度的工作路径。本文共计三万余字，除引言和结语外，正文共分为三个部分，主要内容如下：第一部分，审查逮捕概述。介绍了我国审查逮捕工作的特点以及新刑诉法关于审查逮捕工作修改的背景，进而以新刑诉法第79条关于逮捕条件的规定为逻辑起点，解读相关司法解释、地方法规对审查逮捕工作的新规定。第二部分，当前审查逮捕实务操作的困惑及原因探析。以新刑诉法实施后有关实务部门审查逮捕数据为基础，以相关案例为依据，从逮捕率居高不下、错误不捕、构罪皆捕、无逮捕必要适用以及径行逮捕条款适用等方面着手，查摆存在的问题，，并从执法理念、逮捕条件、证明制度、内部机制运行等方面对产生的问题进行原因探析。第三部分，完善我国审查逮捕制度工作路径的对策。针对在新刑诉法背景下，当前审查逮捕工作存在的问题，在这部分有重点提出了一些建议和意见。主要从诉讼理念更新、诉讼制度改革、听取律师意见、逮捕必要性证明、正确把握逮捕条件、慎重对外来人员适用逮捕措施等六个方面予以阐述，希望对我国审查逮捕工作有所裨益。
[Abstract]:In our country, arrest is the most severe coercive measure, if it is not applied properly, it will violate human rights, so it is very important to study the arrest. The new Criminal procedure Law refines the conditions of arrest and perfects the system of examining and arresting, which has a lot of positive effects on the work of examining and arresting, but from the practical effect since its implementation, there are still many unsatisfactory places. In view of the fact that accurate grasp of arrest conditions is the key point of scientific application of arrest coercive measures, this paper, from the perspective of Article 79 of the New Criminal procedure Law, interprets the relevant provisions of the new Criminal procedure Law on the examination of arrest work, and combines with the confusion in judicial practice. This paper analyzes the reasons and puts forward countermeasures and suggestions in order to perfect the working path of examining and arresting system in our country. The text is divided into three parts, the main content is as follows: the first part, the summary of the review arrest. This paper introduces the characteristics of the review and arrest work in China and the background of the revision of the new criminal procedure law on the review of the arrest work, and then takes the provisions of Article 79 of the new criminal procedure law on the conditions of arrest as the logical starting point to interpret the relevant judicial explanations. New rules in local laws on the review of arrests. The second part analyzes the puzzlement and reasons of the current practice of examining and arresting. Based on the review of arrest data by relevant departments after the implementation of the new Criminal procedure Law, and on the basis of relevant cases, starting from the aspects of high arrest rate, false arrest, arrest for all crimes, no necessary application of arrest and application of arrest clauses, etc. The existing problems are analyzed from the aspects of law enforcement idea, arrest condition, proof system, internal mechanism operation and so on. The third part, perfect our country examine arrest system work path countermeasure. In view of the problems existing in the current examination and arrest under the background of the new Criminal procedure Law, some suggestions and suggestions are put forward in this part. Mainly from the following six aspects: renewing the concept of litigation, reforming the litigation system, listening to the opinions of lawyers, proving the necessity of arrest, correctly grasping the conditions of arrest, carefully applying arrest measures to foreign personnel, etc. It is hoped that it will be beneficial to the examination and arrest of our country.
