应诉管辖原则之制度展开

【摘要】：《民事诉讼法》第127条第2款以不足50字的篇幅对应诉管辖进行原则性规定。基于具体适用规则供给不足,受诉法院强行认定应诉管辖以及当事人滥用应诉管辖等情形在司法实践中层出不穷。为贯彻尊重当事人意愿、减少当事人讼累、避免司法资源浪费的立法宗旨,应诉管辖原则应当在推定合意管辖模式的解释框架下予以制度化。为避免新增的应诉管辖制度打破既有民事诉讼制度系统合理的相对稳定性,应诉管辖规则应当坚持应诉管辖与相关制度相协作的构建思路。
[Abstract]:Article 127 (2) of the Code of Civil procedure provides for the jurisdiction of responding to suit in less than 50 words. Based on the lack of supply of specific applicable rules, the litigant court forcibly determines the jurisdiction of responding to the suit and the parties abusing the jurisdiction of responding to the suit in judicial practice. In order to respect the wishes of the parties, reduce the litigants' litigation burden and avoid the waste of judicial resources, the principle of jurisdiction should be institutionalized under the framework of the interpretation of presumptive consensual jurisdiction. In order to avoid the new response jurisdiction system breaking the relative stability of the existing civil action system, the rules of response jurisdiction should adhere to the idea of cooperation between the response jurisdiction and the related system.
