论诱惑侦查在零包贩毒案件中的适用

【摘要】：诱惑侦查是世界上许多国家为有效地打击毒品犯罪活动所采取的普遍做法,并已取得了明显的效果。近些年来,诱惑侦查在我国的毒品犯罪案件侦查中也得到越来越多的适用,并且零包贩毒案件在毒品犯罪案件中占据较大比重,在零包贩毒案件的侦查活动中诱惑侦查的运用也日益频繁,同时也涌现出诸多问题,然而解决和规范这些问题的具体法律制度在我国立法及司法中呈现真空状态。本文从实务角度出发,对我国零包贩毒案件中适用诱惑侦查的现状以及存在的不足进行分析,提出规制零包贩毒案件中诱惑侦查措施的具体构想。第一部分以司法实践中的三则案例为切入点,引出诱惑侦查在零包贩毒案件中的适用问题。反映了我国零包贩毒案件诱惑侦查的实际情况,分析得出诱惑侦查作为一把双刃剑,如果任由其被滥用而不加以规制,则会带来而侵犯公民权利的不利后果。第二部分对A市B区零包贩卖毒品案件适用诱惑侦查进行实证调研,介绍了A市及B区毒品犯罪和诱惑侦查使用的情况,以及特情人员管理的基本情况,提出A市B区适用诱惑侦查所存在的主要问题。当前,关于毒品犯罪案件的诱惑侦查并没有统一、完善的法律规范对其规制;诱惑侦查的适用毒品案件范围模糊;诱惑侦查的过程中欠缺有效的监督制约机制;诱惑侦查在实践中被滥用的现象时有发生。第三部分提出了规制诱惑侦查在零包贩毒案件中适用的具体构想。明确了诱惑侦查适用时所应当坚持的原则以及细化了具体的规制措施。包括诱惑侦查在零包贩毒案件中适用的原则;适用诱惑侦查的案件范围及对象;完善特情管理;对诱惑侦查进行程序控制;对不法诱惑侦查的救济以及保障辩护人质证权的对应措施。
[Abstract]:Enticement investigation is a universal method adopted by many countries in the world to combat drug crimes effectively, and has achieved obvious results. In recent years, the temptation investigation has been applied more and more in the investigation of drug crime cases in our country, and the zero packet drug trafficking cases occupy a large proportion in the drug crimes cases. In the investigation of zero packet drug trafficking cases, the application of enticement investigation is increasingly frequent, but at the same time, many problems have emerged. However, the specific legal system to solve and standardize these problems presents a vacuum in our legislation and judicature. From the practical point of view, this paper analyzes the present situation and shortcomings of the application of temptation investigation in the zero-packet drug trafficking cases in our country, and puts forward the concrete idea of regulating the temptation investigation measures in the zero-packet drug trafficking cases. The first part takes three cases in judicial practice as the breakthrough point, leads to the application of temptation investigation in zero packet drug trafficking cases. It reflects the actual situation of the temptation investigation in our country's zero packet drug trafficking cases, and draws the conclusion that the temptation investigation as a double-edged sword, if it is abused and not regulated, will bring about the adverse consequences of infringing on the civil rights. The second part carries on the empirical investigation to the A city B area zero packet drug trafficking case application temptation investigation, introduced A city and B area drug crime and the temptation investigation use situation, as well as the special situation personnel management basic situation, This paper puts forward the main problems existing in the application of enticement investigation in area B of A city. At present, the temptation investigation of drug crime cases is not unified, perfect legal norms regulate it, the scope of drug cases of temptation investigation is vague, the process of temptation investigation is lack of effective supervision and restriction mechanism; Temptation investigation is abused in practice from time to time. The third part puts forward the concrete conception of the regulation of temptation detection in zero-packet drug trafficking cases. It clarifies the principles that should be adhered to when the temptation investigation is applied and the detailed regulation measures. It includes the principle of the application of temptation investigation in zero-packet drug trafficking cases, the scope and object of the case applied to the temptation investigation, the perfection of special situation management, the procedure control of the temptation investigation; The remedy to the illegal enticement investigation and the corresponding measures to protect the right of the defender to cross-examine.
