论刑事被害人诉讼权利的程序保障

【摘要】：刑事被害人有许多的诉讼权利,这些权利是有层次之分的,有些是与实体权利相关的程序权利,有些是单纯的程序权利,还有一些是诉讼中涉及到的其他权利。笔者将这些权利分为庭审参与权以及诉讼参与中的其他权利。庭审参与权是被害人诉讼权利的核心,因此这些权利体现了被害人对事实认定以及定罪量刑意见表达；而其他权利则包括引起诉讼开始的报案权、起诉权以及庭审过后的执行参与权以及上诉权等等。赋予被害人相关权利之后,还要有相关的程序制度来保障这些权利的行使,比如为公权力机关设置义务或者用程序制裁制度；且为了不让被害人滥用权力,还有一定的程序限制,使得被害人在行使权利的过程中,不对被告人产生不合理的负效应。程序保障不仅是单独保障被害人的权利,更是在于保障整个诉讼程序的整体效果。要讨论加强刑事被害人的权利,不可避免就会碰到其与司法权力,特别是检察院职权以及被告人权利的摩擦和矛盾。检察院和被害人在某种程度上追求的目的和发挥的作用都是重合的,但是由于检察院代表的更多是国家利益,被害人的利益容易受到排挤；被害人与被告人都拥有当事人的诉讼地位,但是两者的对立导致他们的利益有一种此消彼长的关系,但是在某种角度上,两者之间又在解决社会矛盾的方面产生了合力。文章共分为四章,第一章是对刑事被害人诉讼权利程序保障的概述,简要介绍了被害人、被害人诉讼权利以及程序保障的含义以及对被害人诉讼权利程序保障的价值分析；第二章是探讨被害人诉讼权利程序保障的基本理论,包括被害人诉讼权利的内容、分类,以及被害人权利与公权力、被告人权利之间的关系和平衡；第三章则是根据我国现行刑事诉讼制度中对被害人保护的规定,提出其存在的问题；第四章对我国刑事诉讼制度提出建议如何进一步保障被害人的诉讼权利。
[Abstract]:Criminal victims have many procedural rights, some of which are procedural rights related to substantive rights, some are simple procedural rights, and some are other rights involved in litigation. The author divides these rights into trial participation right and other rights in litigation participation. The right to participate in the trial is the core of the rights of the victim in the proceedings, so these rights reflect the expression of the victim's opinion on the facts and the conviction and sentencing; and other rights include the right to report the case, which causes the commencement of the proceedings, The right to sue, the right to participate in the execution after the trial, the right of appeal and so on. After the victim is given relevant rights, there must be relevant procedural systems to guarantee the exercise of these rights, such as imposing obligations on public authorities or imposing procedural sanctions; and in order not to allow victims to abuse their power, There are some procedural restrictions, so that the victim does not have unreasonable negative effect on the defendant in the process of exercising his right. Procedural protection is not only to protect the rights of victims alone, but also to protect the overall effect of the whole procedure. If we want to discuss how to strengthen the rights of criminal victims, we will inevitably encounter the friction and contradiction between them and the judicial power, especially the power of procuratorate and the rights of the accused. To some extent, the purpose and role of the procuratorate and the victim are identical, but the interests of the victim are easily excluded because the procuratorate represents more national interests. Both the victim and the defendant have the litigant status, but the opposition between them leads to a relationship between their interests, but in a certain angle, there is a resultant force in solving the social contradiction between them. The article is divided into four chapters. The first chapter is an overview of the procedural protection of criminal victims' procedural rights. It briefly introduces the meaning of the victim, the victim's procedural protection and the value of the procedural protection of the victim's procedural rights. The second chapter discusses the basic theory of the procedural protection of the victim's procedural rights, including the content and classification of the victim's procedural rights, as well as the relationship and balance between the victim's rights and the public rights and the rights of the accused. The third chapter is according to our country's current criminal procedure system in the protection of victims, put forward its existing problems; the fourth chapter of our country's criminal procedure system recommendations on how to further protect the victim's procedural rights.
