定罪与量刑分离——论我国死刑案件的证明标准

【摘要】：国外立法和实践对死刑案件和非死刑案件所适用的证明标准或证明程序并不相同,有的是适用较普通刑事案件有罪判决更高的证明标准,有的虽适用相同的证明标准,但在适用的程序上有严格的限制。我国死刑案件并无单独的证明标准,且程序保障制度不完善,为体现对被告人生命权的尊重和保障,对其定罪与量刑应实行不同的证明标准,分别为"排除合理怀疑的唯一性"和"确定无疑的唯一性",将有利于犯罪嫌疑人、被告人的量刑事实的证明标准确定为"可能成立",将不利于犯罪嫌疑人、被告人的量刑事实的证明标准确定为"确定无疑"。
[Abstract]:Foreign legislation and practice apply different standards of proof or procedures to death penalty cases and non-death penalty cases. Some apply higher standards of proof than ordinary criminal cases, and some apply the same standard of proof. However, there are strict restrictions on the applicable procedures. There is no separate standard of proof in death penalty cases in China, and the procedural guarantee system is not perfect. In order to reflect the respect and protection of the defendant's right to life, different standards of proof should be applied to the conviction and sentencing of the defendant. "the uniqueness of beyond reasonable doubt" and "the uniqueness of certainty", respectively, will be beneficial to the criminal suspect, and the standard of proof of the fact of the defendant's sentencing will be determined as "possible", which will be detrimental to the criminal suspect, The standard of proof of the defendant's sentencing fact is determined as "certainty".
