再论少年司法制度的发展及其对我国的启示

【摘要】：少年司法制度发展,大致可分为五个阶段。少年司法制度在其发展过程中,基本上是摇摆于向刑事司法方向还是向福利方向发展之间。通过总结和对比,我国的少年司法制度还存在没有独立的审理少年违法犯罪的程序法、还没有将未成年人犯罪问题作为与成年人犯罪存在着本质上不同的问题来加以对待和处理等问题。对此,应通过修改刑法并在条件成熟时再制定《少年刑法》等法规和措施来加以完善。
[Abstract]:The juvenile justice system can be divided into five stages . In the course of its development , the juvenile justice system basically vacates between the direction of criminal justice and the development of welfare direction . Through summing up and comparing , the juvenile justice system of our country still has no independent procedural law to deal with juvenile delinquency .
