对我国环境公益诉讼制度的构建研究

【摘要】：近几年,随着世界经济的发展,环境问题也越来越突出,自然灾害的频繁发生,给我国的经济带来了巨大的损失。随着世界科学技术的进步,国人开始认识到环境的重要性,但是,在实施的过程中,总会有一些逆潮流的力量在攒动,他们的行为破坏了生态环境和人类社会的和谐发展,给环境保护带来了巨大的压力,在无形中为自己挖掘了坟墓,也给子孙后代挖掘了一条通往地狱的通道。我们应该好好反省我们的环境制度问题,让我国从普通民众到决策机关都积极参加环境保护活动。今天,笔者和大家主要探讨下面几个问题:1.环境公益诉讼的内涵研究,包括美国环境诉讼制度、日本环境诉讼制度以及我们中国学者的观点;2.探讨我国环境公益诉讼制度建立的可行性和必要性,主要从现存法律入手,缓解国际舆论压力为必要条件;3.借鉴国外环境公益诉讼制度的理论和实践,为我国制度的建立提供宝贵的经验;4.最终,我们要构建具有中国特色的环境公益诉讼制度。以上为我们今天要讨论的全部问题,希望能为我国环境公益诉讼的构建提出些许有效建议。
[Abstract]:In recent years, with the development of the world economy, environmental problems are becoming more and more prominent, the frequent occurrence of natural disasters has brought great losses to the economy of our country. With the progress of science and technology in the world, the people begin to realize the importance of the environment. However, in the process of implementation, there are always some forces of reverse flow and their actions. In order to destroy the harmonious development of the ecological environment and the human society, it has brought great pressure to the environmental protection, excavated the grave for oneself in the invisible, and excavated a passage to the hell for the descendants. We should take a good reflection on our environmental system, and let our country actively participate in the environment from the common people to the decision making organs. Today, the author and the author mainly discuss the following questions: 1. the research on the connotation of environmental public interest litigation, including the environmental litigation system in the United States, the system of environmental litigation in Japan and the views of our Chinese scholars; 2. to discuss the feasibility and necessity of the establishment of environmental public interest litigation system in China, mainly from the existing laws to alleviate the country. The pressure of public opinion is the necessary condition; 3. to draw lessons from the theory and practice of foreign environmental public interest litigation system to provide valuable experience for the establishment of our country's system; 4. finally, we should build a system of environmental public interest litigation with Chinese characteristics. All of these are the questions we should discuss today, and hope to make a proposal for the construction of environmental public interest litigation in our country. Give some effective advice.
