行政诉讼一审没有提交的证据不能作为二审判案依据

【摘要】:正案情简介■某市人力资源和社会保障局接到举报,称某电子科技有限公司在招工过程中招用了一名未满16周岁的童工,市人力资源和社会保障局立即派劳动保障监察机构对该公司进行了调查。经核实,该公司在一个月前确曾招用一名童工,举报情况属实。于是,市人力资源和社会保障局责令其清退童工,并根据《禁止使用童工规定》的有关规定,对该公司作出了罚款5000元
[Abstract]:A report was received by the Human Resources and Social Security Bureau of a certain city that a certain electronic technology limited company had recruited a child worker under the age of 16 in the recruitment process. The Municipal Bureau of Human Resources and Social Security immediately dispatched labor security inspection agencies to investigate the company. After verification, the company did recruit a child worker a month ago, the report is true. As a result, the Municipal Bureau of Human Resources and Social Security ordered it to clear off child labour and, in accordance with the relevant provisions of the "provisions on the Prohibition of Child Labour", fined the company a fine of 5000 yuan.
