检察机关提起环境行政公益诉讼问题研究

【摘要】:近几年,因行政机关的行政作为所引起的环境公益诉讼案件,产生了较大的社会影响。我国环境行政公益诉讼开展较晚,新修订的《行政诉讼法》并未将其规定在内。加之《环保法》虽确立了环境公益诉讼制度,但对原告的范围作出限制。1党的十八届四中全会《决定》提出:探索建立检察机关提起公益诉讼制度。为贯彻落实改革要求,最高检发布了《检察机关提起公益诉讼改革试点方案》(以下简称:试点方案)。2作为新生事物,试点工作运行时间较短且缺乏有益的经验,该制度仍存在着许多问题亟待解决,如检察机关职能定位问题未作出解释,存在主导诉讼的风险、受案范围待扩充、案件线索来源单一问题,以及诉前程序中检察建议的运行未明确等问题。本文首先研究了公益诉讼及行政公益诉讼的缘起,在此基础上介绍了我国检察机关提起环境行政公益诉讼的现状、检察机关提起环境行政公益诉讼的法理基础,提出环境行政公益诉讼理论研究不充分、检察机关内部自主性与外部协调性不强、环境行政公益诉讼配套措施不健全等问题。在结合检察机关法律监督职责基础上,就检察机关提起环境行政公益诉讼的职能定位与法律依据、如何完善检察机关内部与外部协调关系以及相关配套制度等方面进行探讨,希望通过本次研究对我国检察机关提起环境行政公益诉讼作出一定的贡献。
[Abstract]:In recent years, environmental public interest litigation cases caused by the administration of administrative organs have had a great social impact. The Environmental Administrative Public interest Litigation in China is late, but the newly revised Administrative Litigation Law does not include it. In addition, although the Environmental Protection Law establishes the system of environmental public interest litigation, it limits the scope of plaintiff. The fourth Plenary session of the 18th CPC Central Committee, "decision", puts forward: to explore the establishment of public interest litigation system by procuratorial organs. In order to implement the reform requirements, the Supreme Procuratorate issued the "pilot Program for the Reform of Public interest Litigation initiated by the Procuratorial organs" (hereinafter referred to as the pilot Program) .2 as a new thing, the pilot work runs for a short time and lacks useful experience. There are still many problems to be solved in this system, such as the unexplained function orientation of procuratorial organs, the risk of leading litigation, the expansion of the scope of cases, and the single source of case clues. And the operation of procuratorial suggestion in the procedure before lawsuit is not clear and so on. This paper first studies the origin of public interest litigation and administrative public interest litigation, and on this basis introduces the current situation of environmental administrative public interest litigation initiated by procuratorial organs in China, and the legal basis of environmental administrative public interest litigation initiated by procuratorial organs. The author points out that the theory of environmental administrative public interest litigation is not enough, the internal autonomy and external coordination of procuratorial organs are not strong, and the supporting measures of environmental administrative public welfare litigation are not perfect. On the basis of the legal supervision duties of procuratorial organs, this paper probes into the functional orientation and legal basis of the procuratorial organs in bringing environmental administrative public interest litigation, how to perfect the internal and external coordination relations between procuratorial organs and related supporting systems, and so on. Through this study, the author hopes to make some contributions to the environmental administrative public interest litigation filed by the procuratorial organs in China.
