民事执行财产查控制度完善研究

【摘要】：“执行难”一直是法院执行工作难以逾越的一道鸿沟,而民事执行工作的实践表明,被执行人的财产难以查控既让被执行人有机可乘,造成了“执行不能”的后果难以合理分担,也是形成“执行难”的主要原因。而执行财产难以查控当然有其社会原因,但财产查控制度本身的问题却不可忽视。本文以我国现行执行程序中的财产查控制度为中心,通过逐一剖析该制度运行的现状及其存在的问题,进而提出适应当今社会信息化建设与完善的建议。具体从三类主要的财产调查方式和途径入手,汇总现行财产查控制度的相关法律规定,结合制度实践操作的现状,区别不同主体的特点,指出导致被执行人财产难以查控的原因；同时结合社会发展及执行实务,依照不同的财产调查方式和途径、不同的财产调查主体所具有的不同地位及其权利、义务和责任等,指出原有制度的不足。在此基础上,针对性的解读近两年新型财产查控制度,如法院与银行、工商、房管、国土、车管等部门建立联动性“点对点”网络集中查询机制等,探讨如何充分利用信息网络资源,改革财产网络查控系统,以进一步完善执行程序；探讨如何发挥网络财产查控的优势,建立科学、完备的电子化集中查控制度,以完善执行财产查控制度的网络保障措施,促进民事执行财产查控工作的高效运行,有效化解“执行难”的问题。
[Abstract]:The practice of civil execution shows that the property of the person subjected to execution is difficult to check and control, which is an opportunity for the person to be executed. It is difficult to share the consequences of the failure of execution, which is the main reason for the difficulty of execution. Of course, there are social reasons for carrying out property inspection and control, but the problems of property inspection and control system can not be ignored. This paper focuses on the property inspection and control system in the current execution procedure of our country. By analyzing the current situation and existing problems of the system one by one, the paper puts forward some suggestions to adapt to the construction and perfection of information technology in the present society. Starting from the three kinds of main ways and means of property investigation, summarizing the relevant laws and regulations of the current property inspection and control system, combining with the current situation of the system's practice operation, distinguishing the characteristics of different subjects, Points out the reasons that lead to the difficulty of investigating and controlling the property of the person executed; Combined with social development and practice, according to different ways and means of property investigation, different property survey subjects have different status, rights, obligations and responsibilities, the deficiencies of the original system are pointed out. On the basis of this, this paper interprets the new property inspection and control system in the past two years, such as the establishment of a "point-to-point" network centralized inquiry mechanism between the courts and banks, industry and commerce, housing management, land, car management, and so on. How to make full use of the information network resources and reform the property network search and control system in order to further improve the implementation procedures; This paper discusses how to give full play to the advantages of network property inspection and control, to establish a scientific and complete electronic centralized inspection and control system, to improve the network safeguard measures for the execution of property inspection and control system, and to promote the efficient operation of civil property inspection and control work. Effectively solve the problem of "difficult to implement".
