实践语境中的非法证据排除规定——以修订后的《刑事诉讼法》为视角

【摘要】：修订后的《刑事诉讼法》关于非法证据排除的规定对于刑事诉讼过程中保障人权和限制刑事司法权规范有效地行使发挥着不可估量的作用,是我国刑事诉讼法治进步和科学的重要标志。但从实践的视角审视,该规定的司法贯彻又面临着许多制度障碍和实践难题,如何从立法和司法的角度最大限度地排除和修正这些阻滞因素从而保证该规定得以有效贯彻和实施就成为刑事司法实践的重大理论课题。
[Abstract]:The provisions of the revised Code of Criminal procedure on the exclusion of illegal evidence play an immeasurable role in safeguarding human rights and restricting the exercise of criminal justice rights in the course of criminal proceedings, It is an important symbol of the progress and science of our country's criminal procedure law. However, from the perspective of practice, the judicial implementation of this provision is faced with many institutional obstacles and practical difficulties. How to remove and amend these factors to the maximum extent from the angle of legislation and judicature so as to ensure the effective implementation of this provision has become an important theoretical subject in criminal justice practice.
